General Terms and Conditions (GTC)

§ 1 Scope For all business relationships between Maxleon Kluge (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer"), the following General Terms and Conditions apply exclusively in their version valid at the time of the order. Deviating conditions of the customer will not be recognized unless the Seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract The presentation of products in the online shop does not constitute a legally binding offer, but an unbinding online catalog. By clicking the "Buy Now" or "Place Order" button, you submit a binding offer for the goods contained in the shopping cart. The Seller can accept the offer within two days by:

  • sending an order confirmation by email, or

  • requesting the customer to pay after placing the order, or

  • delivering the goods. The contract is concluded in German (or English, depending on the shop version). The contract text is stored by the Seller and sent to the customer in text form (e.g., via email) after the order has been placed, along with these GTC.

§ 3 Prices and Shipping Costs The prices stated on the product pages are final prices and include statutory value-added tax (if applicable) and other price components. In addition to the final prices, the Seller charges shipping costs for delivery. The applicable shipping costs will be clearly communicated to the customer during the ordering process before the order is submitted.

§ 4 Terms of Payment Payment is made optionally via the payment methods offered in the shop (e.g., credit card, PayPal, instant transfer, Klarna, etc.). If payment in advance is selected, payment is due immediately after conclusion of the contract.

§ 5 Delivery and Retention of Title Delivery is made to the delivery address specified by the customer, unless otherwise agreed. The goods remain the property of the Seller until the purchase price has been paid in full.

§ 6 Transport Damage If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact the Seller immediately. Failure to file a complaint or contact the Seller has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help the Seller to assert its own claims against the carrier or transport insurance.

§ 7 Warranty (Liability for Defects) The statutory liability for defects applies.

§ 8 Final Provisions The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the Seller is the registered office of the Seller. The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
